Remspeak Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy applies to "consumer health data" as defined by Washington's My Health My Data Act (RCW 19.373) and similar laws, including Nevada's consumer health data law (SB 370) and Connecticut's consumer health data provisions. It is provided by Quality Tools Innovations LLC ("Remspeak," "we," or "us"), which operates the Remspeak app, web app, and website.

1. Categories of consumer health data we collect
When you use Remspeak, we may collect the following consumer health data:
- Sleep data: the times you go to sleep and wake up, your sleep-quality ratings, and how rested you feel.
- Dream and mental-wellness data: dream journal entries and drawings, moods, and whether a dream was a nightmare or recurring.
- Habit and wellness data: check-ins about caffeine, alcohol, meal timing, screen use, exercise timing, and supplements you took.
- Wellness goals: the goals you select, such as improving sleep.
- Information derived from the above: your Sleep Profile (including sleep duration, consistency, sleep debt, and estimated chronotype), sleep schedule recommendations, dream statistics, habit-and-dream comparisons, Dream Connections, embeddings, and AI dream insights.
- Health data from connected services (if you enable them in the future): such as sleep data from Apple Health.
2. Sources
We collect consumer health data directly from you when you enter it in the app. We create derived information from what you enter. If you connect a service such as Apple Health in the future, we will collect data from that service only with your permission.
3. Why we collect and use it
We collect and use consumer health data only to provide the Remspeak features you request, specifically to:
- store and display your sleep records and dream journal;
- calculate your Sleep Profile and recommend a sleep schedule;
- choose research-based suggestions and show how your habits relate to your sleep and dreams;
- find related dreams (Dream Connections); and
- generate AI dream insights, but only when you request them and have given separate consent.
We also use it as needed to keep the Service secure and to comply with law. We do not use consumer health data for advertising, we do not sell it, and we do not use it to train AI models.
4. Categories of consumer health data we share
We share consumer health data only with the processors that help us run Remspeak, under contracts that limit their use of it to providing services to us:
- All categories listed in Section 1: shared with our cloud database, authentication, and storage provider, which stores and processes it on our behalf.
- Dream journal content for AI insights (a dream's title, description, date, moods, tags, ratings, and type, plus the titles, dates, tags, moods, and types of recent non-private dreams), along with your wellness goals: shared with our AI provider only if you give explicit consent and request an insight. Dreams you mark Private are never shared.
We do not share consumer health data with any other third party or affiliate unless you consent or the law permits it.
5. Third parties and affiliates that receive consumer health data
- Supabase, Inc.: database, authentication, file storage, server functions, and on-platform embedding generation (processor).
- Anthropic, PBC: AI dream insights, only with your consent (processor).
We have no affiliates that receive consumer health data.
6. We do not sell consumer health data
We do not sell consumer health data, and we will not do so without your valid, signed authorization as required by law.
7. Your consent
We ask for your consent to collect consumer health data when you create your account, and we ask for separate consent before sharing any of it with our AI provider. You can withdraw consent at any time. Because consumer health data is essential to how Remspeak works, withdrawing consent to its collection means you will no longer be able to use the Service. To do that, delete your account in Profile → Delete account (available on any plan, even if your subscription has ended) or email us.
8. Your rights
Depending on where you live, you have the right to:
- Confirm and access: confirm whether we collect, share, or sell your consumer health data, and access it, including a list of all third parties and affiliates with whom we have shared it and an active email address or other online way to contact them;
- Withdraw consent to our collection and sharing of your consumer health data;
- Delete your consumer health data. We delete it, and tell our processors to delete it, within 30 days after we verify your request. Copies in backups are overwritten within 30 days, and never more than 6 months later;
- Appeal our decision on your request; and
- Not be discriminated against for exercising these rights.
How to exercise your rights
- In the app: delete dreams and drawings, export your data in Profile → Export my data, delete your account in Profile → Delete account, and withdraw AI consent in Profile → Privacy.
- By email: send your request to privacy@remspeak.com. We will verify your identity, usually by confirming control of the email address on your account.
We will respond within 45 days of receiving your request. We may extend this once by another 45 days when reasonably necessary, and if we do, we will tell you why. Requests are free up to twice in any 12-month period.
How to appeal
If we decline to act on your request, you may appeal by emailing privacy@remspeak.com with the subject "Consumer Health Data Appeal." We will respond in writing within 45 days and explain the reasons for our decision. If your appeal is denied, you may contact the Washington State Attorney General at www.atg.wa.gov/file-complaint, or the attorney general of your state.
9. Reviewing and correcting your data
You can review and correct your sleep records, dream entries, habit check-ins, and goals in the app at any time. You can also email privacy@remspeak.com to ask us to correct your information.
10. No third-party tracking
We do not allow any third party to collect consumer health data about you over time or across different websites or online services when you use Remspeak. We don't use advertising or analytics trackers.
11. Changes to this policy
If we make material changes, we will notify you by email or in the app before they take effect. We will ask for your consent again before we collect, use, or share consumer health data in a materially different way. We post every new version here with a new "Last updated" date.
